The Buy American Act Requirements are for public agencies. Shasta Community Health Center is a Private, non profit and does not fall within the scope of this provision.
Buy American Act requirements (for public buildings) under ARRA.
Section 1605 of the ARRA prohibits use of ARRA funds for the construction, alteration, maintenance, or repair of a public building or public work unless all of the iron, steel, and manufactured goods used in the project are produced in the United States. CIP grant awards made to private nonprofit health centers for alteration/renovation and construction do not fall within the scope of the implementing definition of “public building and public work.” Accordingly, CIP grants awarded to health centers that are public agencies (i.e., State and local governments; and multi-State, regional, or interstate entities which have governmental functions) for the alteration/renovation and construction of public buildings are subject to the Buy American provision. These entities should refer to the Federal Register Notice (2 CFR Part 176) at http://edocket.access.gpo.gov/2009/pdf/E9-9073.pdf to ensure compliance with section 1605. Failure to comply may result in unallowable costs/projects.
